論我國數據資源開發(fā)利用的立法完善

摘要： 我國積極探索推進數據要素市場化，加快構建以數據為關鍵要素的數字經濟，圍繞數據資源開發(fā)利用的法律制度體系建設取得了積極進展，形成了覆蓋關鍵環(huán)節(jié)的體系框架及關鍵要求。隨著我國數據要素市場化進程進一步走深走實，與國際數據治理規(guī)則競爭進一步加劇，現(xiàn)有的數據資源開發(fā)利用立法在支撐全國統(tǒng)一數據市場建設，以及引導、規(guī)范開發(fā)利用活動方面存在不足，應在數據基礎設施、數據供給、數據流通、數據應用創(chuàng)新及數據跨境流動等關鍵環(huán)節(jié)進行立法完善。

Study on the improvement of legislation for development and utilization of data resources

Abstract： China actively promotes the marketization of data elements and accelerates the construction of a digital economy with data as the key element. A preliminary legal system has been established for the development and utilization of data resources. This legal system covers key data links and proposes key requirements. With the development of the data element market, China participates in the international competition of of data rules. However, the existing data legal system cannot support the development and utilization of data and is also insufficient to meet the development of a unified national data market. Based on the theoretical research and practical needs, this study concludes with proposals to solve the improvement of legislation problems of data infrastructure, data supply, data circulation, data application and innovation, data crossborder flow.

0 引言
隨著我國數據要素市場化進程進一步走深走實，與國際數據治理競爭進一步加劇，建立健全數據立法成為破解數據要素市場發(fā)展存在問題、搶占國際數據規(guī)則話語權的必然選擇。我國現(xiàn)有的數據資源開發(fā)利用立法在要求細化程度、規(guī)則統(tǒng)一程度等方面存在不足，需在數據基礎設施、數據供給、數據流通、數據應用創(chuàng)新及數據跨境流動等關鍵環(huán)節(jié)進行補充完善，以更好地支撐全國統(tǒng)一數據市場建設，更有力地引導和規(guī)范數據資源開發(fā)利用活動。
