大数据技术中的隐私保护法律问题

摘要： 大数据技术广泛应用的同时也带来了诸多问题，对用户隐私和数据安全造成了严重侵害。由于大数据发展速度快和法律属性界定复杂等原因，现行法律法规存在一定的滞后，对此类问题适用性不佳，需要随着大数据技术的发展进行及时的改进，从而适应日新月异的网络环境。

Legal issues of privacy protection in Big Data technology

Abstract： While Big Data technology is widely used in data space, it also brings many problems, causing serious infringement on user privacy and data security. Due to the rapid development of Big Data and complex definition of legal attributes, existing laws and regulations are somewhat backward and not applicable to such issues. Relevant laws need to be timely improved with the development of Big Data technology, so as to adapt to the ever-changing network environment.

0 引言
隨著網(wǎng)絡在社會中的廣泛普及，人們的工作生活、企業(yè)運作和工業(yè)生產(chǎn)均離不開網(wǎng)絡。依據(jù)《中國互聯(lián)網(wǎng)發(fā)展報告（2021）》提供的數(shù)據(jù)，中國網(wǎng)民在2021年7月數(shù)量達到9.89億人，互聯(lián)網(wǎng)的普及率達到70.4%之高，我國已經(jīng)進入了互聯(lián)網(wǎng)時代。依據(jù)《中國互聯(lián)網(wǎng)發(fā)展報告(2021)》，在2020年中，我國的大數(shù)據(jù)相關產(chǎn)業(yè)的規(guī)模達到718.7億元，同比增長16.0%，增幅在全球大數(shù)據(jù)市場中處于領先地位。大數(shù)據(jù)技術統(tǒng)合計算海量的數(shù)據(jù)，得到精確的預測結(jié)果，使得數(shù)據(jù)在互聯(lián)網(wǎng)時代中成為了新的一種生產(chǎn)力。
大數(shù)據(jù)技術具有“5V”特征，也就是規(guī)模性（Volume）、多樣性（Variety）、高速性（Velocity）、準確性（Veracity）和價值性（Value）[1]。
本文簡要介紹了大數(shù)據(jù)技術產(chǎn)生的一系列問題和相關的法律法規(guī)，以及大數(shù)據(jù)的法律性質(zhì)，并從技術和法律角度給出了建議。
