東盟數(shù)據(jù)治理規(guī)則和中國(guó)-東盟數(shù)字合作研究

摘要: 為加強(qiáng)數(shù)字經(jīng)濟(jì)時(shí)代數(shù)字合作和助力企業(yè)數(shù)據(jù)合規(guī)跨境,從個(gè)人數(shù)據(jù)保護(hù)、網(wǎng)絡(luò)和數(shù)據(jù)安全、數(shù)據(jù)跨境流動(dòng)探討了東盟數(shù)據(jù)治理規(guī)則現(xiàn)狀,分析了區(qū)域合作中面臨的機(jī)遇與挑戰(zhàn)。研究發(fā)現(xiàn),東盟及各國(guó)逐步強(qiáng)化數(shù)據(jù)治理實(shí)踐和監(jiān)管,但是區(qū)域制度協(xié)調(diào)和監(jiān)管實(shí)施趨于復(fù)雜化,加大了區(qū)域各領(lǐng)域數(shù)據(jù)治理合作的阻力。據(jù)此,中國(guó)-東盟命運(yùn)共同體需要夯實(shí)區(qū)域數(shù)據(jù)治理規(guī)則的協(xié)作共識(shí)、打通區(qū)域數(shù)據(jù)跨境監(jiān)管的合規(guī)脈絡(luò)、共建區(qū)域數(shù)據(jù)治理的互信互認(rèn)體系,攜手共建共享更和諧、更安全、更高效的新發(fā)展格局。

ASEAN data governance rules and China-ASEAN digital cooperation

Abstract: In order to strengthen digital cooperation in the era of digital economy and provide support for cross border cooperation on data compliance, this paper discusses the current situation of ASEAN data governance rules in terms of personal data protection, network and data security, and cross-border flow of data.This paper analyzes the opportunities and challenges faced in regional cooperation. The paper found that ASEAN and ASEAN member countries gradually strengthened data governance practices and supervision, but regional institutional coordination and regulatory implementation tend to be complicated, increasing the resistance of regional data governance cooperation in various fields. In view of this, as the China-ASEAN community of shared future continues to make advance, it is required to consolidate the collaborative consensus on regional data governance rules, open up the compliance context of regional data crossborder supervision, build a mutual trust and recognition system for regional data governance, and jointly build and share a more harmonious, secure and more efficient development pattern.

引言

數(shù)字經(jīng)濟(jì)時(shí)代,中國(guó)在“逆全球化”的挑戰(zhàn)中堅(jiān)持推進(jìn)以制度型開(kāi)放為總體定位的高水平對(duì)外開(kāi)放。數(shù)據(jù)成為影響國(guó)家地位和企業(yè)發(fā)展的重要資源。在國(guó)家層面,加強(qiáng)數(shù)字合作、維護(hù)數(shù)據(jù)安全是推動(dòng)行業(yè)數(shù)字化和捍衛(wèi)國(guó)家數(shù)據(jù)主權(quán)的必然要求;在企業(yè)層面,加強(qiáng)數(shù)字化改造、推動(dòng)各環(huán)節(jié)數(shù)字化連接和各部門(mén)數(shù)據(jù)共享是創(chuàng)造更大商業(yè)價(jià)值的必然趨勢(shì)。因此,數(shù)據(jù)治理不僅涉及隱私保護(hù)、商業(yè)機(jī)密和國(guó)家安全,體現(xiàn)政府治理能力,還關(guān)乎國(guó)際數(shù)據(jù)治理規(guī)則制定和數(shù)字經(jīng)濟(jì)合作。為應(yīng)對(duì)數(shù)據(jù)保護(hù)主義的蔓延,中國(guó)逐步構(gòu)建公權(quán)主導(dǎo)的數(shù)據(jù)跨境治理的多層規(guī)范體系,參與國(guó)際標(biāo)準(zhǔn)制定,推動(dòng)重點(diǎn)領(lǐng)域規(guī)則和標(biāo)準(zhǔn)的相通相融,打造透明協(xié)同的高標(biāo)準(zhǔn)治理體系[1]。東盟與中國(guó)的貿(mào)易往來(lái)正不斷加強(qiáng),學(xué)者們針對(duì)中國(guó)-東盟的合作研究集中在貿(mào)易結(jié)構(gòu)和規(guī)則[2-3]、互聯(lián)互通建設(shè)[4]和產(chǎn)業(yè)合作[5-6]等方面所帶來(lái)的經(jīng)貿(mào)挑戰(zhàn)和潛力;對(duì)于數(shù)據(jù)治理的研究,學(xué)者們主要聚焦國(guó)際數(shù)據(jù)治理的立場(chǎng)分歧和全球發(fā)展態(tài)勢(shì)[7-9]。在數(shù)據(jù)治理的合作研究上,主要聚焦東盟與全球數(shù)據(jù)治理規(guī)則的對(duì)比[10],著重剖析東盟內(nèi)數(shù)字鴻溝所帶來(lái)的跨境數(shù)據(jù)流動(dòng)治理差異[11-12]。數(shù)據(jù)治理合作是中國(guó)-東盟數(shù)字合作的基礎(chǔ),鮮少有文獻(xiàn)就東盟的數(shù)據(jù)治理現(xiàn)狀展開(kāi)細(xì)致的梳理,就中國(guó)-東盟間的數(shù)據(jù)治理合作研討可行性路徑。因此,本文通過(guò)全局性梳理東盟及各國(guó)數(shù)據(jù)治理規(guī)則差異,充分辨析中國(guó)與東盟開(kāi)展數(shù)據(jù)治理合作的機(jī)遇與挑戰(zhàn),為推進(jìn)區(qū)域內(nèi)的數(shù)據(jù)治理合作提供依據(jù)并提出三點(diǎn)建設(shè)性意見(jiàn)。1東盟數(shù)據(jù)治理規(guī)則現(xiàn)狀與合作挑戰(zhàn)自2020年歐洲議會(huì)發(fā)布《歐洲數(shù)字主權(quán)》,正式提出追求“數(shù)字主權(quán)”,各國(guó)家紛紛提出了自身的數(shù)據(jù)治理主張。全球數(shù)據(jù)治理體系在數(shù)據(jù)權(quán)屬上強(qiáng)調(diào)個(gè)人數(shù)據(jù)保護(hù),在國(guó)家安全上強(qiáng)調(diào)網(wǎng)絡(luò)和數(shù)據(jù)安全,在國(guó)際貿(mào)易上強(qiáng)調(diào)數(shù)據(jù)合規(guī)跨境[13]。
