我國(guó)數(shù)據(jù)跨境流動(dòng)的形勢(shì)、現(xiàn)狀與機(jī)制研究——以自貿(mào)區(qū)為例

摘要： 為探索符合我國(guó)國(guó)情的數(shù)據(jù)跨境流動(dòng)機(jī)制，選取在發(fā)展機(jī)制上具有先行先試優(yōu)勢(shì)的自貿(mào)區(qū)為樣本，通過(guò)文獻(xiàn)分析、案例分析，歸納總結(jié)了數(shù)據(jù)跨境流動(dòng)當(dāng)前面臨的國(guó)內(nèi)外形勢(shì)，挖掘出數(shù)據(jù)跨境在高效便利安全上不足的相關(guān)問(wèn)題，提煉出自貿(mào)區(qū)在數(shù)據(jù)跨境領(lǐng)域的主要實(shí)踐經(jīng)驗(yàn)和特點(diǎn)，從技術(shù)、服務(wù)、制度三方面提出建議，以期為打造中國(guó)特色的數(shù)據(jù)跨境流動(dòng)機(jī)制提供借鑒。

Research on the situation, current status, and mechanism of cross-border data flow in China——taking the free trade zone as an example

Abstract： To explore a cross-border data flow mechanism that aligns with China′s national conditions, we selected Free Trade Zones (FTZs) with pioneering advantages in development mechanisms as our sample. Through a meticulous blend of literature review and case study analysis, we synthesized the current domestic and international landscape of cross-border data flow. We revealed challenges pertaining to insufficient efficiency, convenience, and security in cross-border data operations, and extracted pivotal practical experiences and characteristics from the FTZs in the realm of cross-border data flow. Based on these insights, we formulated recommendations across technology, services, and systems, aiming to provide invaluable perspectives for constructing a cross-border data flow mechanism that embodies Chinese characteristics.

引言
數(shù)據(jù)要素在全球貿(mào)易發(fā)展中日益重要，數(shù)據(jù)跨境流動(dòng)已成為全球經(jīng)濟(jì)復(fù)蘇的必要條件，成為數(shù)字經(jīng)濟(jì)時(shí)代全球化發(fā)展的重要特征。自由貿(mào)易實(shí)驗(yàn)區(qū)（以下簡(jiǎn)稱“自貿(mào)區(qū)”）作為我國(guó)對(duì)外貿(mào)易的先鋒，積極利用自身制度和政策創(chuàng)新優(yōu)勢(shì)，加速開(kāi)展數(shù)據(jù)跨境流動(dòng)探索，已成為數(shù)據(jù)跨境流動(dòng)機(jī)制創(chuàng)新的前沿陣地，為數(shù)據(jù)跨境流動(dòng)積累新經(jīng)驗(yàn)。本文以自貿(mào)區(qū)為例，重點(diǎn)探討了當(dāng)前數(shù)據(jù)跨境流動(dòng)的堵點(diǎn)、痛點(diǎn)、難點(diǎn)，自貿(mào)區(qū)在數(shù)據(jù)跨境流動(dòng)的實(shí)踐探索，以及哪些方向可以成為下一步發(fā)展關(guān)鍵，以期為我國(guó)數(shù)據(jù)跨境流動(dòng)機(jī)制的構(gòu)建提供借鑒。
